These Terms of Use (“Terms”) govern your use of afreemove.com (the “site”), powered by Ameritex Movers. By using the site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site. Partners and agents accept the version of these Terms shown above when they register, and are asked to accept new versions when they change.

About afreemove.com

afreemove.com helps renters and buyers find participating apartment communities, condos, townhomes, rental homes and homes for sale in the Houston and Dallas areas. Listings are provided by participating property management companies, leasing offices and realtor partners (“partners”). afreemove.com is not a real estate brokerage, landlord or property manager, does not represent buyers, sellers, landlords or tenants, and is not a party to any lease, purchase or other agreement between you and a partner.

The Free Move program

• The Free Move is offered and funded by participating properties and realtor partners. Each partner sets its own Free Move budget, shown in dollars or hours, and its own eligibility rules.
• Free Moves are subject to lease or purchase qualification and to the terms of the specific promotion. Moves are carried out by Ameritex Movers.
• Free Move bookings are arranged through your property or realtor. You cannot book a Free Move through this site; once your lease or purchase is confirmed, your property contacts Ameritex Movers and a team member reaches out to you.
• If a move takes longer than the budgeted time, or you request additional services, specialty items or extra time, you may be responsible for the difference.
• Partners may change or end a Free Move offer. The offer shown on a listing is not a guarantee until it is confirmed by the partner.

Using the site

You may use the site for your own personal, non-commercial search for a home, and partners may use it to manage their listings. You agree not to:

• copy, scrape, harvest or index listings, photos or contact details by automated means, or use them to build a competing database;
• interfere with the site’s security or operation, probe for vulnerabilities, or bypass rate limits or spam protection;
• submit false enquiries, impersonate anyone, or send spam or unsolicited messages through the site;
• use the site in a way that breaks any law, including fair housing, consumer protection, privacy and anti-spam laws.

Enquiries and communications

When you send an enquiry, it goes to the partner responsible for the listing. Partners respond to you directly, and are responsible for their own communications, application processes, fees and decisions. Only provide information you are comfortable sharing with the partner.

Partner and agent accounts

• Accounts are available to property management companies, leasing offices, realtors and brokerages that apply with a business email address and are approved by us. We may approve, decline, suspend or close an account at our discretion.
• You must give accurate, current information, keep your login details secure, and are responsible for activity under your account and your team’s accounts.
• Realtors and brokerages must hold the licenses required by the Texas Real Estate Commission (TREC) and comply with TREC rules; property partners must comply with applicable landlord-tenant laws.
• You must have a lawful basis to share any resident or client details you submit, including consent for Free Move referrals.

Listing accuracy and partner obligations

• Partners are responsible for the accuracy of their listings, including rents and prices, availability, floor plans, fees, policies, photos and the Free Move allowance, and must update or remove listings promptly when they change or are no longer available.
• Partners must own or have permission to use all photos, floor plans, logos and text they upload, and grant us a non-exclusive license to display them on the site and in our marketing of the listing.
• We may review, edit for format, decline or remove listings that do not meet these Terms. We do not verify every listing and do not guarantee that listings are accurate, complete or available.

Prohibited content

You may not post or send content that:

• indicates any preference, limitation or discrimination based on race, color, religion, sex, disability, familial status, national origin or any other class protected by federal, Texas or local law;
• is false, misleading or deceptive, including bait-and-switch pricing or availability;
• infringes someone else’s copyright, trademark, privacy or other rights;
• is obscene, threatening, harassing or defamatory;
• contains personal information about others without their permission, malware or links to harmful sites; or
• promotes a business, service or property unrelated to the listing.

Fair housing

afreemove.com supports the Fair Housing Act and equal housing opportunity. All partners must comply with federal, Texas and local fair housing laws. We may flag or remove listings with potentially discriminatory wording.

Intellectual property

The site’s design, text, graphics, logos and software are owned by or licensed to afreemove.com and Ameritex Movers and are protected by law. You may not reuse them without written permission, except to view and share links to the site.

Third-party websites and services

The site links to and embeds third-party websites and services, such as partner websites, maps, YouTube videos and the Power to Choose website. We are not responsible for their content, offers or policies.

Tools and estimates

Calculators and guides on the site, including the rent affordability calculator, give general estimates for planning only. They are not financial, legal or tax advice, and each property sets its own requirements.

Disclaimers

The site and all listings and content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the site will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, afreemove.com, Ameritex Movers and their affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from listings, partner conduct, leases, purchases or your use of the site. Our total liability for any claim relating to the site will not exceed one hundred dollars (US $100). Some jurisdictions do not allow these limits, so they may not apply to you.

Indemnification

You agree to defend, indemnify and hold harmless afreemove.com, Ameritex Movers and their affiliates from claims, losses and expenses (including reasonable attorneys’ fees) arising from your content, your listings, your breach of these Terms or your violation of any law or the rights of others.

Suspension and termination

We may suspend or end access to the site or to an account, remove content, or change or discontinue any part of the site at any time, with or without notice, including for a breach of these Terms.

Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute relating to the site will be brought in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction.

Changes to these Terms

We may update these Terms from time to time. Each version has a version number, shown at the top of this page, and we record which version each partner has accepted. Continued use of the site after a change means you accept the updated Terms; partners may be asked to accept the new version before they continue using their account.
